The European Commission has asked Apple (NASDAQ:AAPL) to tell why the company prohibited Epic Games from launching its own online marketplace on iPhones and iPads in Europe and if this violates EU technology rules, Reuters reported.

The Fortnite video-game maker said on Wednesday that a new developer account created by Epic in Sweden was terminated by Apple. Epic, which is partly owned by Tencent (OTCPK:TCEHY) (OTCPK:TCTZF), said it planned to use its developer account to bring Fortnite and online marketplEpic Games aims to take advantage of the EU’s Digital Markets Act, or DMA, which comes into force on Thursday and requires Apple to open up its eco-system to competitors.

“We have requested further explanations on this from Apple under the DMA,” the report added citing a statement from the European Commission.

“We are also evaluating whether Apple’s actions raise doubts on their compliance with the DSA and the P2B (Platform to Business Regulation), given the links between the developer programme membership and the App store as designated VLOP (very large online platform),” the report added.

Apple re-affirmed on Thursday that it exercised its rights which has been provided by the courts.

“Epic’s egregious breach of its contractual obligations to Apple led courts to determine that Apple has the right to terminate ‘any or all of Epic Games’ wholly owned subsidiaries, affiliates, and/or other entities under Epic Games’ control at any time and at Apple’s sole discretion,” the report noted citing an Apple spokesperson.

The tech giant added that in light of Epic’s past and ongoing behavior, Apple chose to exercise that right.”
